Terms of Service

These Terms of Service govern access to and use of the vFlip website, mobile applications, AI avatar features, subscriptions, account tools, notifications, and related services.

1. Acceptance of Terms

By accessing or using vFlip, a user agrees to be bound by these Terms and the vFlip Privacy Policy. If a user does not agree to these Terms, the user may not access or use the Service.

These Terms apply to all users of the Service, including users who access vFlip through the website, mobile applications, or any related platform.

2. Eligibility

The Service is intended for users who are at least 13 years old. Users under 18 may use the Service only with appropriate permission from a parent or legal guardian and only where permitted by applicable law.

vFlip may restrict, suspend, or terminate access where required by law, safety obligations, platform rules, or operational requirements.

3. Description of the Service

vFlip provides entertainment-oriented AI avatar experiences, including text, voice, video, and related interactive features. Avatars and responses are generated or supported by automated systems and may be fictional, simulated, inaccurate, incomplete, delayed, or inconsistent.

Unless expressly stated by vFlip, avatars are not real people and are not affiliated with, endorsed by, or representative of any real person, brand, or organization.

4. Accounts and Security

  • Users are responsible for activity that occurs through their accounts.
  • Users must keep login credentials, magic links, devices, and authentication methods secure.
  • Users must provide accurate account information and keep account information reasonably current.
  • vFlip may suspend or restrict accounts associated with fraud, abuse, security risk, legal risk, or violation of these Terms.

5. User Content

Users retain ownership of content submitted to the Service, subject to any rights held by third parties or platform providers. User content may include text, voice, images, prompts, conversation history, feedback, and related metadata.

By submitting content to the Service, a user grants vFlip a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, reproduce, display, adapt, and use that content as reasonably necessary to operate, maintain, secure, support, and improve the Service.

Users may not submit content that is illegal, infringing, abusive, exploitative, deceptive, or otherwise harmful.

6. AI Output and No Professional Advice

AI-generated output may be incorrect or unsuitable for a user's circumstances. vFlip does not provide medical, mental health, emergency, legal, financial, or other professional advice.

Users should not rely on the Service for emergency support, crisis support, professional decisions, or safety-critical information. Emergency services or qualified professionals should be contacted where appropriate.

7. Prohibited Conduct

  • Using the Service for unlawful, abusive, harassing, threatening, exploitative, or deceptive purposes.
  • Impersonating another person or misrepresenting identity, affiliation, or authorization.
  • Uploading malware or attempting to disrupt, overload, scrape, reverse engineer, or gain unauthorized access to the Service.
  • Bypassing usage limits, billing systems, safety controls, access restrictions, or technical protections.
  • Submitting content that infringes intellectual property, privacy, publicity, or other rights.
  • Using the Service to generate or distribute illegal, sexually exploitative, or otherwise harmful content.

8. Subscriptions, Purchases, and Billing

vFlip may offer subscriptions, credits, trials, or other paid features. Billing may be processed by vFlip or by third-party platforms such as app stores, payment processors, or subscription management providers.

Subscriptions renew automatically unless canceled before the renewal date through the applicable billing provider or platform account settings. Prices, features, packages, trial availability, and renewal terms may change as permitted by law.

Refunds are handled according to the policies of the applicable billing provider and any requirements of applicable law.

9. Third-Party Services

The Service may rely on third-party providers for hosting, authentication, storage, AI processing, voice and video infrastructure, analytics, payments, email, push notifications, and other operations. Those providers may process information under their own terms and policies.

vFlip is not responsible for third-party services, outages, integrations, policies, or conduct outside vFlip's direct control.

10. Intellectual Property

The Service, including the vFlip name, logos, software, product design, interfaces, avatar systems, text, graphics, and other materials, is owned by vFlip or its licensors and is protected by intellectual property and other laws.

These Terms do not grant users any ownership interest in the Service or vFlip intellectual property.

11. Suspension and Termination

vFlip may suspend, restrict, or terminate access to the Service at any time if vFlip reasonably believes that continued access creates legal, security, operational, safety, fraud, abuse, or policy risk.

Users may stop using the Service at any time. Account deletion requests may be submitted through the account deletion process and may require verification.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, vFlip disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, vFlip and its affiliates, officers, employees, agents, partners, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption.

14. Changes to These Terms

vFlip may update these Terms from time to time. If changes are material, vFlip may provide notice through the Service, by email, or by other reasonable means. Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.
